Equal Access to Curriculum & Educational Resources Essay
Conduct a print and electronic media research using vetted sources on at least two cases of documented unequal access (Not limited to the State of Massachusetts) to the curriculum and other educational resources related to race. Analyze the cases using the following prompts and then write an essay to be published in the opinion page in any of the major print media on how to remedy the inequities described in your research.
Historical presentation using federal and state laws on equal access (Brown vs Board of Education, Lau vs Nichols, Massachusetts Education Reform Act, etc.)
What are the facts in the cases analyzed?
Content Area issue (Under-enrollment in AP/College level courses or over-enrollment of students of color in special education, English Learners/Limited English Proficient), Highly Qualified teachers, Technology
District Policies (Does the school district have a facially neutral policy or practice that produces an adverse impact on students of a particular race, color, or national origin when compared to other students?).
Recommendations (Present 3-4 strategies that you as the curriculum leader will use to remedy the issues in at least two cases analyzed in your essay).

For my research regarding unequal access to curriculum, I have chosen to focus on special education students. Working for a special education collaborative, I have seen that there can be issues in regards to students being educated in a least restrictive environment once they are placed in a public day program. When special education students are pulled from their sending district and placed in out of distinct programs, this affects their right under IDEA. According to IDEA Section 1412 Section (5) Least Restrictive Environment (a) in general, “To the maximum extent appropriate, children with disabilities, including children in public or private institutions or other care facilities, are educated with children who are not disabled, and special classes, separate schooling, or other removal of children with disabilities from the regular educational environment occurs only when the nature or severity of the disability of a child is such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily.”
For cases where students have severe disabilities, out of district placement may be necessary for learning and growth to take place, but I feel that there needs to be increased effort on the school districts part to include these students in curricular or extra curricular activities amongst their nondisabled peers. This is specifically true in regards to Social Emotional Learning of self and social awareness.
Three cases I found that stood out to me regarding special education inequality were:
-Mills v. Board of Education of District of Columbia (1972) and
-Oberti v. Board of Educ., 801 F. Supp. 1392 (D.N.J. 1992)
-Board of Education v. Rowley (1982)
These three cases deal with denying rights to students with disabilities. Two of the cases sided in favor of the special needs students and one ruled in favor of the school district stating FAPE was provided.
